WINTER 2022 SHISHA LOUNGES SHISHA: STAY WITHIN THE LAW The popularity of shisha lounges is growing and more premises are opening up across the UK. But there are strict rules to follow for those running shisha lounges, to ensure they are safe and operating lawfully The practice of shisha smoking has been slowly spreading across Europe and shisha lounges are springing up right across the UK. It is becoming an increasingly popular social pastime, particularly among young people. For the owners of shisha lounges, there are strict regulations in place. Here we take look at them, to help you ensure you are compliant: Waterpipes can only be smoked in the open air. Where a smoking shelter is provided, it must be at least 50 per cent open at all times. Planning permission: if you change the use of a building, make physical changes to the building, or are erecting a smoking shelter, you are likely to need planning permission. If you are erecting any new structure or changing existing buildings you may also be required to make a Building Regulations application. Fire safety: The business owner must make sure a written fire risk assessment is undertaken. There must be means of tackling a fire for example, fire extinguishers staff trained to use them, and an adequate way of raising the alarm in the event of fire. All furnishings and drapes must meet the required standards so as not to ignite easily. Fire exits must be unlocked and have clear and proper signage. Licences: If you are providing alcohol, certain types of entertainment or refreshments after 11pm you are required to apply for a premises licence. The product: Shisha containing tobacco must have been notified to Public Health England. The list of products that require notification will soon be updated. Shisha Lounges – Business Guidance
What is shisha.
Shisha is a specially prepared tobacco that is heated to produce smoke which bubbles through a bowl of water and into a long hose-like pipe to be breathed in. Shisha pipes have a mouthpiece fitted to inhale the smoke. The tobacco can come in different flavours and sometimes it’s mixed with a dark brown sugar (called molasses sugar), often making the smoke smell sweet. It is usually heated by burning wood, coal, or charcoal.
The Health Act 2006
The Health Act 2006 makes it a requirement to keep indoor public places and workplaces, including work vehicles, smoke-free. These smoking laws also apply to water pipes whether the shish product being smoked contains tobacco or not. The legislation was designed to protect workers and members of the public from the serious health risks of second-hand smoke.
What are the offences?
- Failure to display a no smoking sign - up to £1,000 if prosecuted and convicted by a court or £200 fixed penalty notice on whoever manages or occupies the premises.
- Smoking in a smoke free place - up to £200 if prosecuted and convicted or a penalty notice of £50 on the person smoking.
- Failing to prevent smoking in a smoke free place - up to £2,500 maximum fine on whoever manages or occupies the premises if prosecuted and convicted.
If your business supplies shish in water pipes to customers, you need to do so legally. Following this guide will enable you to do this, but failing to comply may result in prosecution or having your pipes and shisha tobacco seized and your customers being fined.
Where can customers smoke?
As with smoking a cigarette the smoking of shish/water pipe is not permitted within substantially and fully enclosed public spaces or workplaces because of the smoke free laws.
Water pipes can be smoked in open air when there is no roof or ceiling above the smoker. They can also be smoked in some circumstances where there is a roof or ceiling, but only if at least 50% of the walls of the structure are permanently open. Any opening that can be closed - for example by a door, window, or shutter is counted as closed. So, unless your business has access to a legal smoking area you will not be able to supply shish in water pipes.
If you are thinking of constructing or changing the structure or use of a building for, use as, a smoking shelter, you may require planning permission. Planning permission may also be required to use any part of a property for a shish smoking lounge. More information is available on the Planning page . Health & Safety of Employees and Customers
Supplying shish will involve additional risks which you should assess and control. Risk assessments must be documented where you employ five or more staff. Risks include infectious diseases, burning charcoal and spillages. Staff should be trained to control the risks and respond to incidents.
You should also take the additional risks into account when completing the Fire Risk Assessment and Emergency Plan for the premises. To minimise the transference of infection, water pipe mouthpieces and hoses should be cleaned thoroughly and disinfected between users. Disposable mouthpieces are recommended. If your staff light the pipes, they should use their own personal mouthpiece and then put a clean one onto the pipe.
It is important that users of shish are made aware of the health issues. A misleading but commonly held belief is that smoking through a water pipe ‘purifies’ the smoke.
What can I sell and who to?
You can only sell tobacco products that have been legally imported into the UK - anything imported illegally could be seized by Trading Standards, HMRC or the Police. The vast majority of shish products containing tobacco are not imported legally and will not have had the required duty paid on it.
No tobacco product can legally be supplied to anyone under 18 years old. Given that water pipes are normally shared, you must check the ages of the whole group and any friends who subsequently join them. It may be sensible to allow only over 18s into the premises.
Although smoking is not a licensable activity. A potential breach of an existing premises licence may occur if you significantly change your business activity and change the nature of use of premises . A licence and its conditions normally pertain to specific business activities and the lay-out and design operating at that time. Proprietors of licensed premises with smoking zones should be aware of any restrictions within their licence. Noise nuisance, anti-social behaviour and criminal activity
If your business is in or near a residential area, it is your responsibility to make sure that your activities do not create a noise, lighting, smoke, or other nuisance for your neighbours. What will happen if you ignore this advice?
Illegal shish businesses will not be tolerated in Gravesham. Non-compliant businesses risk receiving fines or being prosecuted and can expect regular visits from the council and their partners until we are satisfied the place is compliant with relevant legislation. Is Shisha covered by the smokefree legislation? Yes. The Smokefree (Premises & Enforcement) Regulations 2007 prohibit the use of shisha pipes in all enclosed public places and workplaces. The law prohibits the smoking of tobacco and anything that contains tobacco and any other substance. Therefore it applies to all manufactured cigarettes, hand- rolled cigarettes, cigars, herbal cigarettes and pipes, including hookah water pipes, whether or not the particular product being smoked is tobacco or not. Shisha Lounges Closed For Planning Law Violations
A London council has recently taken the relatively rare step of demolishing two shisha lounges built in East Ham.
The two lounges were in violation of planning laws, but more importantly ignored demands made in the form of enforcement notices and even official police visits.
This is what led to the drastic steps taken. If the brothers involved had attempted to meet the terms of the enforcement notices, it may have been the case that they two lounges would have been able to continue to operate in some form.

What Should I Take Into Account Before Opening A Shisha Lounge?
A shisha or hookah lounge can still operate, but due to stringent anti-smoking regulations you must not allow smoking within an enclosed or substantially-enclosed area.
A substantially enclosed area is any area with a roof or shelter and more than fifty percent of the area taken up by walls. This is an informal description to make the situation easier to understand – you should note that doors, windows, and walls that are less than a certain distance away from the roof or shelter will be counted as if they were walls.
In addition, shisha lounges face many of the issues of other meeting places – noises and smells caused by customers and by smoke can amount to statutory nuisances, and get your establishment into trouble.
Other planning regulations of particular relevance to shisha lounges include fire and gas safety, which are often much more important for shisha lounges due to the frequent fire hazards.
What Went Wrong In Newham?
In Newham specifically, the brothers who built them allegedly failed to take even the initial step of appealing for planning permission. Had they taken this step, it may have been the case that permission would have been granted.
Enforcement notices had been issued, but ignored. If they had paid attention to the enforcement notice and taken action to meet the demands involved, it could have been that a subsequent legitimate appeal for planning permission would have been looked on more kindly.
All in all, this case was unusual. In most cases, if you present your planning permission correctly then your shisha lounge should go ahead just fine. You simply need the help of someone experienced in the area.

Cambridge restaurant and bar refused alcohol licence over noise concerns
A new restaurant and bar in Cambridge has been refused a licence to sell alcohol after councillors claimed neighbours noise concerns appeared to have been “disregarded”.
The Sunset Lounge in Cherry Hinton Road wanted to sell alcohol from 11am to 10pm all week.
It promotes itself as a Mediterranean restaurant offering a shisha lounge and “authentic bar experience”.
But neighbours objected to the application, arguing the area was not suitable for the type of late-night drinking and shisha lounge proposed.
Some said they were already experiencing an increase in noise since it replaced the previous takeaway restaurant.
At a meeting of Cambridge City Council’s licensing sub-committee on Monday (5 February ), councillors heard the business was currently subject to a planning enforcement notice.
Councillors were told that the extension at the back of the restaurant did not have planning permission, and the business did not have planning approval to run a shisha lounge either.
Counsel Graham Goodwill, representing the applicant Valmir Dautaj, said the extension had been built following “wrongful information” given by a planning officer.
He said Mr Dautaj had been told he could build an extension as long as it was no higher than two-and-a-half metres, but that is the case for a domestic property and not a business.
He added that an appeal had been submitted against this enforcement notice.
Mr Goodwill told councillors he wanted to propose amendments to the licence application to “take the sting out of some of the objections”.
He said Mr Dautaj was proposing not to run a shisha lounge and would “mothball” the extension until the outcome of the appeal was known.
That meant the licence sought would cover the main restaurant building and the seating area at the front.
He asked to extend the licence application to include Sunday, telling councillors that a previous agent representing Mr Dautaj had made an “error” in only requesting a licence from Monday to Saturday.
Mr Goodwill said: “Mr Dautaj has spent in the region of £160,000 in carrying out the renovations that you see - quite a bit of it was spent on the extension out the back.
“The plan is for this to be a mid-range restaurant. I have seen the menus, starters are approaching £10, main course £30 or thereabouts, so the clientele he is seeking are good quality customers.
“This is not another Indian restaurant, Chinese restaurant, or takeaway burger type food. This is top quality food.
“During the past two months the premises have been opened on a number occasions under temporary event notice licences.
“On behalf of Mr Dautaj, we say that this restaurant adds a terrific amenity to the community, the opportunity for residents from nearby streets to attend and have a nice meal.”
Cllr Anna Smith (Lab, Coleridge), one of the ward councillors, said she was hearing reports about noise issues and asked for assurances.
Mr Goodwill said the restaurant was not now seeking a licence to cover the extension, which he said he understood to be the main cause of noise concerns.
But Cllr Smith said people living in the flats above had raised complaints about “significant noise levels” coming up through the floor, which were worse than when a takeaway was on site.
Mr Goodwill said the kitchen had been in use for more than 30 years and in 1994 it was found that there was no need for any additional noise restrictions.
He added that if there was any “unacceptable noise”, people could raise the issues with the city council, which could test if there is a statutory noise nuisance.
Cllr Smith “remained unconvinced about what might be done to improve the noise nuisance”.
After considering the application in private, the sub-committee refused the application as councillors did not think residents’ concerns had been “adequately addressed”, with no mitigation or intended alterations” to address concerns.
The decision notice said: “Up until now, the Sunset Lounge has been presented up as a shisha bar, with amplified music and dancing in the promotional material.
“The sudden change in the narrative to a quiet family restaurant raises concerns going forward as to the actual use of the venue.
“No positive responses were provided to residents [and] councillors’ noise concerns.
“Residents’ objections appeared to be disregarded and no goodwill was shown to address their concerns.
“Neither the application nor the representations provided any adequate measures to reduce noise nuisance.
“Significant use of the [temporary event notices] suggests the intended use of the venue as a bar as opposed to a family restaurant.”
The council’s decision can be appealed by the applicant within 21 days of the decision.
Shisha Lounge application in Tower Hamlets approved

The client tried to submit her own application after starting her Shisha lounge and being told to stop by Tower Hamlets Council. However, it was lacking information such as scaled drawings, the correct application forms, planning statement etc.
